2. Scope

These T&Cs apply to all sales made to consumers (B2C) through the Site. Any order placed implies full and unconditional acceptance of these T&Cs. Product descriptions and information displayed on individual product pages prevail in case of discrepancy.

3. Products and availability

• Products are described as accurately as possible on the Site.
• Products may be new or refurbished / pre-owned. The condition is clearly stated on each product page.
• Product images are for illustration purposes only and are non-contractual.
• Availability is indicated on the Site and may change without notice.

4. Prices

Prices are displayed in euros (€) and include all applicable taxes (VAT), excluding delivery fees where applicable. SMARTY reserves the right to change prices at any time. The price applied is the one displayed at the time of order confirmation.

5. Orders

• Orders are placed online through the Site.
• An order confirmation email is sent once payment is validated.
• SMARTY reserves the right to cancel or refuse an order in case of suspected fraud or pricing error.

6. Payment

Payment is due in full at the time of order. Available payment methods are displayed during checkout.

• Payments are processed via secure payment providers.
• Orders paid by bank transfer may be processed after receipt of funds.
• In case of payment refusal, the order may be automatically cancelled.

7. Delivery and in-store pickup

7.1 Delivery

Products are delivered to the address provided during checkout. Delivery times are indicative and may vary due to transport conditions.

7.2 In-store pickup

In-store pickup is available for selected products at: 152 Avenue de Saint-Ouen, 75018 Paris. Pickup confirmation may be required before arrival.

8. Right of withdrawal

In accordance with EU consumer law, customers have a 14-day withdrawal period from the date of receipt of the order, without giving any reason.

Returned products must be complete, in good condition and accompanied by all accessories. Return shipping costs are borne by the customer unless the product is defective or incorrect.

9. Legal warranties

Customers benefit from the legal warranty of conformity and the warranty against hidden defects, in accordance with applicable French and EU laws. Any commercial warranty is detailed on the relevant product page.

10. Liability

SMARTY shall not be held liable for indirect damages such as loss of data or business interruption. Liability shall in any case be limited to the amount of the relevant order, as permitted by law.

11. Personal data

Personal data is processed in accordance with our Privacy Policy and applicable GDPR regulations.

12. Governing law and disputes

These T&Cs are governed by French law. In the event of a dispute, customers are encouraged to contact SMARTY to seek an amicable solution before any legal action.
